Wind Tower Regulations Annulled

In his decision dated January 5, 2009, NYS Supreme Court Justice David Michael Barry annulled the Local Wind Law. As a result, the Town reverted back to the regulations which were previously in effect. Under those regulations, land owners are permitted to construct, with a building permit, residential wind tower not exceeding 50 feet in height (from base to tip of blade extended). The Town is considering its options in regards to the Judge’s decision.
